To the maximum extent permitted by applicable law, kx8019's total liability to you in respect of any claim arising out of or in connection with this Agreement or your use of the platform shall not exceed the total amount deposited by you into your kx8019 account in the 30 days immediately preceding the event giving rise to the claim. kx8019 shall not be liable for any indirect, consequential, special, punitive, or incidental damages, including loss of profits or loss of data.
Nothing in this Agreement limits kx8019's liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
Amendments. kx8019 reserves the right to amend these Terms and Conditions at any time. Where material amendments are made, kx8019 will take reasonable steps to notify registered players, including by displaying a notice on the platform or by sending an email to the address registered on the player's account. The amended terms will take effect from the date of publication on the kx8019 website. Your continued use of the platform after the effective date of any amendment constitutes your acceptance of the amended terms.
Termination by kx8019. kx8019 may terminate this Agreement and close your account at any time, with or without cause, by giving you notice. Where termination is without cause, kx8019 will return any available balance in your account via an approved payment method. Where termination is due to breach of this Agreement, the provisions of Section 7 (Prohibited Conduct) will apply regarding the treatment of your account balance.
Termination by Player. You may terminate this Agreement by closing your kx8019 account in accordance with Section 3 of this Agreement. Termination does not affect any rights or obligations that have already accrued prior to the date of termination.
Survival. Sections relating to intellectual property, limitation of liability, prohibited conduct, and governing law shall survive the termination of this Agreement.
This Agreement and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the applicable laws governing the operation of the kx8019 platform.
Dispute Resolution. In the first instance, any dispute or complaint should be submitted to the kx8019 support team via the contact details set out in Section 14. kx8019 will investigate the matter and aim to respond with a resolution within 14 working days of receiving a fully documented complaint. kx8019 is committed to fair and transparent dispute resolution and will treat all complaints seriously and impartially.
Escalation. Where a dispute cannot be resolved to the player's satisfaction through the internal complaints process, the player may escalate the matter in accordance with the applicable dispute resolution procedures. kx8019 will cooperate fully with any such process.
Entire Agreement. This Agreement, together with the Privacy Policy and any applicable promotional terms, constitutes the entire agreement between you and kx8019 with respect to the subject matter hereof and supersedes all prior agreements, representations, and understandings between the parties.
Severability. If any provision of this Agreement is found to be invalid, unlawful, or unenforceable by a competent authority, that provision shall be severed from the remainder of the Agreement, which shall continue in full force and effect.
